1. About these terms
These terms of service govern your use of the website at daleharris.co.uk (the “Site”). By accessing or using the Site you agree to be bound by them. If you do not accept them, you should not use the Site.
The Site is operated by Dale-Harris & Co of Huxley House, 11 William Street, Redditch, Worcestershire B97 4AJ, a firm of Chartered Certified Accountants regulated by the Association of Chartered Certified Accountants, firm reference [TO CONFIRM]. 2. Relationship with our engagement terms
These terms relate to the Site alone. The provision of accountancy, taxation, payroll, audit and related professional services is governed by a separate written engagement letter and accompanying standard terms of business agreed with each client. In the event of any conflict between these terms and an engagement letter, the engagement letter prevails in respect of the services.
No client relationship is created by using this Site, by submitting an enquiry, or by attending a free consultation. A client relationship arises only when an engagement letter has been signed by both parties and our client acceptance procedures, including identity verification, have been completed.
3. Information on the Site is general in nature
The content of the Site is provided for general information only. It does not constitute accountancy, tax, legal, investment or other professional advice and must not be relied upon as such. Tax legislation, rates, thresholds and HM Revenue & Customs practice change frequently, and content may become out of date.
You should obtain specific professional advice addressed to your own circumstances before taking, or refraining from taking, any action. To the fullest extent permitted by law, we accept no liability for any loss arising from reliance on Site content by any person who is not a client acting under a signed engagement letter.
4. Acceptable use
You agree not to: use the Site for any unlawful purpose or in breach of any applicable law; attempt to gain unauthorised access to the Site, its servers or any connected system; introduce any virus, trojan, worm or other malicious code; conduct any automated scraping, harvesting or data extraction without our prior written consent; misuse any contact form, including for the transmission of unsolicited commercial communications; or use the Site in any way that damages, disables, overburdens or impairs it, or interferes with any other party’s use of it.
5. Intellectual property
All content on the Site, including text, layout, graphics, design, logos and the compilation thereof, is owned by or licensed to Dale-Harris & Co and is protected by copyright and other intellectual property rights. You may view, download and print extracts for your own personal or internal business use. You may not otherwise reproduce, distribute, publish, adapt or commercially exploit any part of the Site without our prior written permission.
6. Third-party links
The Site may contain links to third-party websites, including HM Revenue & Customs, Companies House and software providers. Such links are provided for convenience only. We have no control over the content of those sites, do not endorse them, and accept no responsibility for any loss arising from their use.
7. Availability
We do not warrant that the Site will be available uninterrupted, timely, secure or error-free. We may suspend, withdraw or restrict all or part of the Site for business or operational reasons without notice. We will use reasonable endeavours to give notice of any planned suspension.
8. Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded.
Subject to that, and to the fullest extent permitted by law, we exclude all conditions, warranties, representations and other terms which might otherwise be implied into your use of the Site, and we will not be liable for any loss of profit, loss of business, business interruption, loss of anticipated savings, loss of data or any indirect or consequential loss arising out of or in connection with the use of, or inability to use, the Site.
9. Communications and security
Email is not a secure medium. While we take reasonable steps to protect our systems, we cannot guarantee the security or integrity of information sent to us by email or through the Site. Please do not send bank details, identity documents or other sensitive information by ordinary email; we will provide a secure method on request. We will never email you to request a change of bank details, and any such message purporting to come from us should be verified by telephone before any payment is made.
10. Complaints
We aim to provide a high standard of service. If you are dissatisfied, please raise the matter in the first instance with your usual contact at the firm, or in writing to the address above. Complaints concerning our professional services are handled under the procedure set out in our engagement terms, and clients may ultimately refer a complaint to the Association of Chartered Certified Accountants.
11. Governing law and jurisdiction
These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
12. Changes
We may amend these terms at any time by posting a revised version on this page. The version in force is the one published at the time you use the Site.
